1. Agreement to these terms

These Terms & Conditions ("Terms") are the rules for using the PainPoint Solution website, our assessment, and our consulting services (all together, the "Services"). The Services are provided by PainPoint Solution, LLC ("PainPoint," "we," "us"). When you send an assessment, hire us, or use the Services in any other way, you agree to these Terms for yourself and for the business you represent.

If you don't agree with these Terms, please don't use the Services. But if something here bothers you, email info@painpointsolution.com and we're happy to talk it through.

2. What the Services are

PainPoint helps businesses run better. Our work has three steps:

  • The assessment — a form where you tell us about your business, what's working, and what isn't.
  • The plan — we check your answers with PainPoint's own model to find the problems most likely to matter. This is a starting point for a consultant, not a final answer.
  • The consultation — a PainPoint team member reads your assessment and gets back to you. If you decide to hire us, they work with your team to put a fix in place.

Sending an assessment doesn't mean you've hired us, and it doesn't require either of us to do anything. It just starts a conversation. Any paid work is covered by a separate written agreement. If that agreement says something different from these Terms, the agreement wins.

3. How we use AI

AI is part of how PainPoint works, and we want to be clear about where and how we use it:

  • AI-assisted analysis — after you send an assessment, an AI agent reviews your answers using the PainPoint Diagnostic, our own method for finding where businesses lose money. It uses common business research and general knowledge of how businesses run to point out where similar businesses usually find their biggest wins. This is how we create the plan described in Section 2.
  • Outside AI company — the agent mostly runs on Anthropic's Claude AI models, which read your answers for us to create that analysis. Your assessment answers are not used to train AI models. Our Privacy Policy explains how that data is handled.

What the AI produces is a starting point, not a final answer. A human consultant reviews every plan before we give you any advice. We don't let AI make final decisions about your business, and we don't use your answers to identify or single out any other company.

4. What we ask of you

To get the most out of the assessment and any work we do together, we ask that you:

  • Give us true, honest information about your business. The more honest your answers, the better our advice. We're not checking your math, so rough numbers are fine, but information you know is false is not.
  • Are allowed to share this information for your company, or have your employer's permission to do so.
  • Understand that any numbers, plans, or advice we give you are based on what you tell us, and can only be as accurate as that information.

5. Fees and payment

The assessment is free, and you don't have to buy anything after it. If you decide to hire us, the price, when you pay, and what you get will be written down in a separate agreement. We don't charge anything or ask for payment details for the free assessment.

6. No guaranteed results

PainPoint brings real experience to your assessment and any work we do together, but we can't promise specific results, like saving a certain amount of money or time. Every business is different, and results depend on things we can't control, including how your team puts our advice into action. The example results shown on our site are just examples, not a promise of what you'll get.

7. Keeping things private

We keep what you share in your assessment private and use it only as our Privacy Policy describes. If you hire us, the written agreement will usually include a promise from both sides to keep each other's information secret (an NDA), since by then we're often looking at more sensitive details.

8. Who owns what

The PainPoint name, our model, our assessment method, and any tools or materials we create for general use belong to us. Advice, plans, and other work we make just for you are yours to use in your own business once you've paid for them in full. Neither of us can use the other's name, logo, or project details in advertising without written permission. That includes customer reviews on our site, which we'll only post if you clearly say yes.

9. Limits on what we owe

As far as the law allows, the most PainPoint can owe you for any claim about the Services (the free assessment or paid work) is the amount you actually paid us for that project in the past twelve months. PainPoint is not responsible for indirect, incidental, or consequential damages (losses that happen as a side effect, such as lost profits) that come from using our advice. Nothing in these Terms limits what we owe where the law doesn't allow it to be limited.

10. Ending our work together

Either of us can end paid work by following the notice rules in that project's written agreement. During the free assessment, either of us can stop at any time. Nothing locks you in before paid work begins.

11. Which laws apply

These Terms follow the laws of the State of Tennessee and the federal laws of the United States, even if another state's laws might otherwise apply. Any legal dispute about these Terms will be handled only in state or federal courts in Tennessee, and both of us agree to those courts handling it. The only exception is if a written agreement for paid work sets up a different way to settle disputes (such as arbitration, where a neutral person decides instead of a court).

12. Changes to these terms

We may change these Terms from time to time, and we'll update the "last updated" date at the top when we do. For important changes, we'll tell current clients directly instead of only updating this page. If you keep using the Services after a change, that means you accept the new Terms.
